As a strategic legal partner to our clients in the construction industry, we provide a wide range of solutions and services related to construction law. JHJ prepares and negotiates complex design and construction agreements, including “fast-track,” fixed price, cost plus, design-build, build-to- suit and public and private venture contracts. We have been involved in all phases of a construction project, working with contractors, architects, engineers, governments and industrial suppliers to ensure smooth deliverance of project milestones. Our services range from advisory and documentation to dispute resolution via litigation, arbitration, adjudication (in particular under the Construction Industry Payment and Adjudication Act 2012 (CIPAA)) and other alternative dispute resolution processes.
Projects
Our team represents government linked companies (GLCs), construction companies, developers, suppliers and other private entities that contract with federal, state and local government agencies. We regularly represent clients in bid preparation, contract adjustment and claims proceedings, licensing, and other government procurement works. We also assist clients in privatisation exercises and joint venture creation where required for the project.
Our clients range from the architects responsible for the design of the Prime Minister’s official residence in Putrajaya, to international joint venture companies dealing with the design construction of air conditioning systems for multi-storey buildings. We have also represented the Selangor State investment arm in the negotiation and documentation of a turnkey project. The project concerned the construction of the Main Campus and Student Campus for the Industrial University of Selangor in Batang Berjuntai.
Project Financing
Our team is experienced with capital markets and the various project facilities from commercial banks, export credit agencies and multilateral development banks. We have extensive experience in handling project financing for projects related to transportation infrastructure, residential and commercial development, as well as communications infrastructure. Our team also advise on all related aspects of project financing, including the performance of due diligence and consultation on regulatory, corporate and securities matters.
Labour & Employee Safety and Health Matters
We negotiate and interpret collective bargaining agreements to ensure the continuity of projects in the face of labour disputes, and assist clients in complying with employment laws and regulations including wage, age, race, disability and gender employment discrimination as well as equal employment opportunity issues. Our team also advise on regulatory compliance with the Occupational Safety and Health Act (OSHA) Regulations. We have been regularly engaged to represent clients in matters relating to worksite inspections and investigations, to contest citations issued by the regulatory agencies and to defend citation-enforcement litigation.
