Employment (Amended) Act 2012

The Malaysian Employment Act 1955 had been amended via the Employment (Amended) Act 2012. The amended Act came into force on the 1st of April, 2012.


The highlighted amendments made to the Act includes:

  • Changes to the mode of payment for employee salaries/wages;
  • Introduction of sexual harrassment at the workplace as a criminal offence;
  • Bolstering of maternity related entitlements;
  • Introduction of the term "Contractors For Labour";
  • Broadening of the scope of the Act to include employment of foreign domestic servants;
  • Increasing the wage threshold covered by the Act from RM1,500 to RM2,000;
  • Introduction of personal liability of directors or other officers for offences committed by a body corporate.
