Scope of Our Transportation Practice

JHJ serves its clients in the many dimensions of the transportation industry including rail, vehicle supply, as well as transport infrastructure. We have a proven track record in the transport sector whereby we have provided legal services to commuter railroads, public authorities and government agencies. We have an equally active practice assisting private sector companies, including investment bankers and other investors, planning consultants and engineers, developers, contractors, operation and maintenance companies, transit and bus operators and material and equipment suppliers in their dealings with the public transportation sector and each other.

Our Team

Our Transportation team has proficient knowledge on matters related to the transport industry, which extends to issues concerning industrial disputes. This team consists of lawyers with diversified and substantial experience who have held positions in transport related Government agencies. As such we are able to provide the strength and depth in meeting the business needs of the transport industry. Our characteristics and approach encompasses the thoroughness, intellectual rigour and a level of commercial-mindedness that is lacking in many conventional practices.

Rail

Our practice has developed over the years in the transportation industry particularly in rail with the expansion and upgrading of Malaysian rail since the late 1990’s. Building on work undertaken at the time in relation to industrial disputes, the leasing, maintenance and movement of rolling stock as well as on the complex arrangements for spares provision; we have successfully expanded the practice to encompass regulatory, infrastructure and light rail work enabling us to maintain the leading position among legal practices in the Malaysian rail industry.

As the structure of the Malaysian rail industry continues to evolve, the market for legal services in Malaysian continues to develop. This evolution together with the rapid expansion of light rail transport in Malaysia, offers opportunities across a range of practice areas where our specific industry knowledge and traditional strengths come to fore.

Recently, this team has been instrumental in representing our clients in the facilitation of the feasibility study, negotiations and legal documentations concerning the enhancement of the public transport system within the Klang Valley. The work concerned the fleet expansion of the Light Rail Transit system, which involved the purchase of a new fleet, upgrade of the Automatic Train Control System (ATC) and wayside E&M System upgrades. The pivotal role played by our team played in structuring the legal and commercial facets between our clients and their foreign suppliers and service providers ensured that the negotiations went on faultlessly.

Vehicle Supply & Transport Infrastructure

Our team has participated in other dimensions of the transport industry. This ranges from commercial negotiations, import agreements for vehicle supply to the drafting of various Conditions of Contract for building, design and engineering works in accordance to international standards pursuant to the FIDIC model.

This team has also the experience in tying up business and commercial aspects for the purchase of imported cars and the drafting of legal documentation concerning imports. We have also collaborated business deals between our clients and local car manufacturers concerning the purchase of its assets (vehicles & engines) for the purpose of repackaging and selling it to suit the Malaysian market.
